Terms and Conditions

Orders

Andy Burke only accepts orders under the terms and conditions defined here and will only place an order on the manufacturing schedule on the receipt and clearing of the deposit payment. Please be aware that Andy Burke Historical Shoes and Boots is a one person company.

Andy Burke will make products in accordance with the specifications agreed with the customer at the time of order. Any subsequent changes to the product specification or customer specification/measurement error may be charged on a time and materials basis.

Andy Burke is not in breach of contract for any reason if there is a problem producing or a delay in producing the product in accordance with the customer order due to, but not limited to, industrial action, delay in material acquisition, labour, fuel, machinery failure, power failure, bad weather, illness or any other issue not under Andy Burke's control.

There is a minimum of 24 weeks from order receipt to delivery. This timescale can increase, sometimes considerably, depending on workload and things beyond reasonable control of Andy Burke, as above.

Prices

Quotations are valid for 1 month from the date of issue.

Andy Burke reserves the right to change advertised prices from time to time.

Payment

There are normally two stages to the payment, a non-returnable deposit and balance payment. The balance payment is required on notification of product completion. The customer must pay the balance and the funds cleared within 7 days of completion notification. Failure to do so may result in the goods being sold.

Andy Burke accepts credit and debit cards, cheques, electronic transfers and cash as payment. Cheques should be made payable to "Andy Burke" and crossed Account Payee Only. For electronic transfers please Contact Us

Dispatch

Andy Burke will notify customers, usually by phone or e-mail, when their orders are complete. He will not dispatch products until payment has been made and funds cleared.

Carriage Charges

Carriage and insurance are charged at the current rate. Andy Burke accepts no responsibility for delays resulting from carrier error or negligence. In the event of goods being lost or suffering damage in transit, Andy Burke will replace the affected items within a reasonable timescale after insurance/customer payment.

Care of All Leather Footwear

As with all leather products, regular maintenance is required. Originally, people would protect their footwear by applying leather treatments made from available fats, etc. Customers should now use modern proprietary leather treatments/water proofing products in accordance with the manufacturer's instructions.

The leather will stretch, especially if it gets wet. This is normal and all bespoke products are slightly tight in an attempt to minimise the effect of the natural stretching.

When drying leather products it is important to dry them slowly, else the leather will go hard and crack. Generally, it is best to pack the shoes or boots with newspaper and let the product dry naturally. The customer must treat the leather with a proprietary product to replace the natural oils lost after drying.

Andy Burke will not accept any responsibility for product failure due to a lack of maintenance or if he suspects mistreatment.

Liability

Historical footwear does not have the same grip as most modern shoes, especially when wet. The customer knowingly accepts this increased risk and accepts that Andy Burke will not be liable for any resulting injuries. Customers must be cautious when walking on wet or slippery surfaces, especially if not wearing the appropriate pattens. Any modifications to products are entirely at the customer's own risk.

Andy Burke provides shoe buckles separate from the shoes. If the customer asks Andy Burke to fit customer supplied buckles he may do so. Andy Burke provides no guarantee that they will fit right first time. Also no liability will be accepted for subsequent adjustment holes or future fit.

Complaints

Andy Burke aims to ensure that customers are completely satisfied with his products but realise that from time to time this may not be the case. Where there is customer dissatisfaction Andy Burke encourages customer feedback and will endeavour to investigate and rectify the issue as quickly as possible. The customer must report any dissatisfaction within 14 days of product receipt.

Returns and Replacements

Andy Burke does not normally accept returns arising from a customer error or for bespoke orders but he will always try to resolve any such issues fairly as agreed with the customer.

In addition, the product must be in a saleable, as delivered condition and not damaged, for example after the customer wearing the products outside or after fitting buckles or hob nails.

Please contact Andy Burke with any product dissatisfaction.

Data Protection

Any personal information kept by Andy Burke will not be disseminated to anyone without written permission of the customer. Customer foot measurements and order forms are kept for a minimum of 5 years. No credit or debit card details are kept at all.

Terms and conditions may change from time to time at the discretion of Andy Burke
